Torture is definitely a controversial agenda when it comes down to human rights vs. National security. But not only was Mahmoud Hussein far from threatening the national security, but also he was not charged in the first place, by the authorities who kept him for 500+ days of interrogation, incarceration, and brutal torture which compelled Hussein into signing a false confession.
